Wanting to move early

Hi All,

Tenant here, we had the house sold by the old landlord (we got on great) and the new guy has not been great.

Since Aug, fire door latch not fixed on internal bedroom door - said he would do it and not for me to

Shower temperature cant be adjusted. On going since Aug ( We arranged for it be done when we went on holiday in Oct as it was a 4 day job ( retiling) however it wasnt done. There is no other way to wash in the house.

Back gate doesnt shut and leaves property unsecure

I recently ( 2 weeks ago) asked in writing for an update on when these could be done (not demanding now, just an update) I have still not had a response.

I have never been behind on rent ( I pay 2 months ahead) and I am disabled and so is our young son.

The AST ends in April but we are desperate to move as he is also very rude, we generally feel like we are not wanted.

My thought is if we move in December and pay rent till end of Jan to allow him time to sort stuff out.

Please give me your opinions.

The holiday season is upon us...

I'd at least suffer until the new year, and that is not that far from April.

Times passes more swiftly when you're having fun. It doesn't. Time is a constant. It's just the appearance or interpretation that makes it seem like time is moving faster when you're having fun and, conversely, slower when you're not. Concentrate on a well-executed search for a new property that meets all your requirements when you're not thinking about presents and get-togethers, and aren't wading through slush.

You may, in time, find out you are not wanted... and something appealing may come your way. You never know. People contemplate things at year-end. Imagine if your Landlord came to you in January and said - I'd like to [insert excuse or reason], but I'm happy to end your tenancy early by helping with moving costs"... it could happen, has happened.

For now, although it doesn't feel like it, you hold the power. You know what you want to do - and will do it. Leave it until April and leave him with an empty unearning house on his hands. You don't even need to provide plenty of notice if it's at the end of a fixed term and you are no longer there.

That's all me, though. You might not be able to handle five more months, even though it's not that long.

Thanks. I understand the sentiment.

To be honest we have now found the perfect replacement home.
I'm going to pay for the referencing ( I offered as I was open that if our current landlord said no then we are stuck) then speak to current landlord to get "blessing".

You need to write to your current Landlord, clearly detail what is outstanding and for how long.

Advise that you do not wish to remain at the property and ask if he will accept early surrender in 1 month (without charge).

IF he says no, write again to explain that you are not happy and will now involve the Councils Environmental Health team as you have been without washing facilities for so long.

Explain you have found another property and would rather he re-consider his stance which would in turn avoid the hassles linked to a report to EHO.

You should NOT be paying for any referencing at the new property.

If you current LL has half a brain cell he will agree with your early termination. If not, then you are wasting your own money by offering to pay for referencing on any potential new home.

What is going on?  Is there some new form of polite trolling, where we give advice in good faith, only to end up with a  punchline that makes it all irrelevant?

Write a firm letter as advised

Refer to the items that STILL require repair and what they mean to you and your son, e.g. being scolded or water too cold.

Then say that as you have been waiting for months you would like to leave without penalty and keep things amicable, otherwise you will be forced to involve the Council, seek an improvement order and seek damages and compensation under Section 11 of the Landlord and Tenant Act (1985) for disrepair and breach of contract.

Add that as you and your son are disabled so vulnerable Tenants these things are especially important and their lack of response has required you to seek alternate accommodation.

Explain that "Time is of the essence" and you need a reply from him within 24 hours or you will have to inform the Council.
