Tenancy Agreement - cannot have witnesses that are parties to the agreement?

Hi,

I am about to finalize and sign Tenancy agreement with private landlord. We have this agreement ready to be signed. I am 1 tenant and my wife is 2 tenant. Next to each tenant signatures there is a witness box where details of the witness are present together with a space for witness' signature. My idea was to that my wife could be my witness and I can be hers. Unfortunately, the landlord wrote:

"Sorry you cannot have witnesses that are parties to the agreement, you have to get neighbours or friends, this is a legal requirement"

Is that correct?

Well, it is and it isn't. It's true that you can't have a witness who's a party to the arrangement but the fact is you don't need witnesses for a simple contract like a tenancy agreement anyway: they're only a legal requirement for a deed.

Having said that, it's not really worth arguing the toss over, just get a mate to witness it and enjoy your new home!
