RE- LEAVING A PROPERTY BEFORE END OF TERM DUE TO ILLNESS

Hi all ,

I am looking for advice regarding leaving our tenancy a year early due to the most horrendous personal  conditions .My 25 year old was diagnosed with ovarian Cancer back in November last , she was also 4 months pregnant at the time  . one operation to remove said tumor later ,putting my daughter and unborn granddaughter at risk  we are now 7 months into the pregnancy and my daughter is receiving the most wonderful care form the christie ,Manchester and Preston Royal .

Baby is due to be induced some time in the next few weeks and My daughter has then to endure Chemotherapy  ..with said new born Baby , my granddaughter .

I need / want to be there for her and the baby  and leave this property to move to the same Town she lives in , also we are supporting her financially through this and therefore need to downsize to a smaller rental property with a smaller rent to allow for the extra finance .

We have written to our landlord and had a meeting with him in his offices just next door and although I was literally in bits in the meeting he refuses to let us off the lease until either  he or us find a replacement tenant . I know legally he can do this ..I think ..however do I have grounds for compassionate extenuating circumstances allowing us to leave the property .The landlord has also broken section 11 of the landlord and tenant Act 1985 by not repairing leaking windows and doors in the property  to the point of water dripping in trough the kitchen ceiling  .The central heating doesnt work properly and we have been freezing this winter . He has refused to repair either .
How would a court view all this  if he tried to sue us if we just leave ...oh and by the way our landlord is a trustee for Cancer Research UK !! Can you believe that !
We have found a cheaper alternative property 5 minutes from my daughters and desperately need to move before my grand daughter arrives .
can anyone advice us please , this is like torture .  :'( :'(  Thank you in advance

Please don't think like this.

You do not need any more stress in your life.

Market your property to rent through free avenues like Gum Tree, Facebook, newsagent window etc, look at low cost options like rightmove £39 on here.

Get interested parties ( especially those who want to move straight away) to come do a viewing when you can get the landlord there to "interview" them.


It might not be 100% fair, but it will get you the result you want as quickly as possible, and may motivate your landlord to "soften" a little on his stance.

Sounds like a terrible situation but the agreement you entered into protects both parties.  If the landlord became ill and had to move to the other side of the country it wouldn't be fair to kick the tenant out early because of this.  Boboff's advice seems good.
