hi,help and advice needed please.was in a 6 month contract on a 2 bedroom property which has now ended.im still in the property but the landlord will not give me a 6 month contract only a verbal month to month contract.they will not even sign a month to month contract.are my rights still the same......    also the roof is leaking water,always has and still is and the landlord has done nothing about this as ive mentioned this many of times.

If your initial fixed term tenancy has ended, then without notice being served on you to vacate or a new fixed term tenancy being issued, you are automatically in a Statutory Periodic Tenancy (month to month), both yourself and the landlord are bound by the original terms of the tenancy but on a monthly basis with no fixed term.  You can give one months notice at any point, the landlord should has to give a minimum of two months notice to expire at the end of a fixed period of the tenancy (at least two full months notice which expire the day before the next lot of rent is due).

As for the maintenance issue.  If there is no answer from the landlord on this after repeated requests, phone calls, emails etc (keep these logged) then if its that bad, arrange for two quotes yourself and forward them to the landlord advising if he doesnt get the issue sorted within X time frame (should be reasonable time frame) then you will go ahead with Quote X and no longer pay.  the rent will be used to pay for the works.

If anything, this action should provoke a response at the least, but covers you if the landlord wants to take you to court for non payment of rent.
