Hello
I moved in to my 1st property as a single person June 2016 I paid my deposit of 1000 to landlord the day before. After hearing nothing for 2 months and after asking for a tenancy agreement the landlord turns up with one dated 24th August 16, she has wrote on it next to deposit "no deposition scheme will be used" she has signed next to this, me being nieve also signed.
Being a new renovation I thought things would go fine as all new.
2 years on the shower leaks, the landlords attempts to fix it themselves leave it covered in mould with woodlouse and silverfish everywhere, the toilet and sink were never fixed to the floor and subsequently moved, the roof leaked leavintage a huge hole in the roof,  this continues for 6 months after letters and requests to fix the landlords become nasty and blame me for damages. January this year I involved environmental health.
Landlords continued to lie and make up breach of tenancy becoming aggressive to the point I have issued a claim for non protection of deposit in the court is am just waiting for a hearing date.
The landlords have made rubbish up how the place was not ready to move in to untill the tenancy was issued August and the keys were only given for furniture deliveries, I have witness statements and proof I was paying rent from June 2016.
The EPCross was not even created until end August 2016.
Sorry for the rant only this landlord is awfull and any advice if I have a chance at beating them in court would be appreciated as I would not like anyone elselse to fall bad with them.
They are professional landlords with over 10 years experience and 11 properties

If the Deposit was not protected then you will be successful in Court. Putting down "no deposition scheme will be used" (sic) does not provide the Landlord with any right - whatsoever - of actually doing that. They cannot opt out of the legislation, no matter what they might write and have you sign. It's impossible. Therefore, it not only acts as a brilliant piece of evidence to support your case, it also demonstrates premeditation on their part, likely increasing the penalty from the 1x some might expect, up to the higher level of 3x. Happy days?

Thank you, hopefully. It's never been about the money itsb there behaviour as professionals with over 10 years renting. The lies 😈in hope a judge sees through.
I really don't want anyone to go through this with her. But I doubt they will change.

They may be forced to rethink their behaviour in future, regarding at least the deposit. It sounds as if you could get £3,000,and you deserve every penny.Well done for fighting back, these people are bullies who need to be taught a lesson.
