Ending a tenancy early

We rented for 10 years and have a yearly tenancy agreement but this is only signed by 1 person (2 people are named on the agreement) and it's not witnessed.  We want to end the agreement about 4 months early by giving 1 months notice - can we do this or does the landlord have the right to ask for the other 4 months rent?

Tough one.

This is my take.

If your agreement is not valid, then you are deemed to be under a 6 month AST, therefore you can give a months notice.

They will not agree.

Easiest option to stay cool, and communicate nicely, if you can explain, and try and work with them, based on them finding someone to move in after say 6 to 8 weeks, and you rent it till then, it might be okay. Best to be open and honest and helpful, and if they wont play mention the fact the agreement is wrong etc etc.

Thank you for your advice.  We've decided to stay where we are for time being and hopefully find someone when tenancy comes to an end.
