Late payment of Rent Deposit into DPS

How can I evict my tenant whom I was late to deposit his rent deposit  into  DPS? His tenancy was AST and it becomes  periodic after the  6 months of fixed term. I  tried to return his deposit but refused to accept it so as to use S21 and his not owing any rent arrears. I got stocked, your advice is needed please.

Return his deposit and use a section 21.  Do you have a bank account number for him?  If not write a cheque, get proof of writing it and proof of postage an proceed from their.  It's up to them to cash the cheque, you've given the deposit back, the judge will find it strange that the T is not cashing it/accepting it to remain eviction free forever.

Thank you Sir,
I went to him to discuss this issue with him in a personal way so as to let him understand but he just text  me back saying that his lawyer advised him not to collect it, therefore he will like to take to his lawyers' advice.

I suppose it gets a bit messy if you post it to him, and then he posts it back to you. :D

It sure will but the judge will see him as playing silly buggars on purpose.

Thanks, it was action taken before with the hope that the man will understand but  acted negative.  I have sent it to him now. Thanks for your advice.
