Hi All,

Total newbie here and think I have just done a very stupid thing.

In essence I rented out my house and after 2 months of tenant being in I was being contacted by neighbours making allegations and complaints about alleged anti social behaviour and my place being a mess etc.  I wont go into the allegations here but suffice to say I elected not to renew the tenancy at the 6 month point.

Tenant moved out and I went to see house, place was a mess, filthy and with some damage also tenant had tried to paint with white vinyl over magnolia emulsion walls, place had been freshly decorated and carpeted prior to the tenant moving in so I was a little upset.  Asked Agent what references they took and they admitted none >:(.  I asked how I could recoup some of my costs as I was clearly going to have to replace at least one carpet and also repaint entire home before I could move someone else in they said tenant on dole "not really worth it" etc etc.  I said that I was going to go after them as I felt they had failed me in their service by not checking out tenant as I had paid for and also they took a new "remarket" fee from her final rent which they refuse to return to me despite me not using them now and instructing another agent.

I sent complaint letter to them and they have replied to me saying as I didn't claim on tenants deposit the place must have been okay.  I have photos of when they gave it back to me and even have an email from the agent who they sent to give me the keys back asking if I got the place sorted so they know they are lying. 

Any advice?  Is it worth complaining to the TPO or will they say same thing ref deposit?

Its the agent's responsibility to sort out the deposit in the scheme and thus their responsibility to manage the property (that's why they charge £50+ a month) rather than just a one-off finder's fee for finding the tenant.

Yes. Your agent is in the wrong; go after them ; they are hoping you won't want the hassle; but often your fees / expenses to pursue this would be added to your claim against them.
You would clearly win this . They did not do what you paid them to do.
