tenant refuses to leave after giving one months notice

help anybody please,
have a tenant on 6 mths shorthold tenancy, nightmare paying rent and at month 5 finally agreed to go, he gave us one months written notice, he is currently 6 weeks in arrears and is now refusing to go on the date he originally gave us.
can i legally get him out as he has given us written notice, or do i have to go s21 route and wait another 2months,
any help would be good thankyou

What ways were you thinking?  The legal way to me is for him to leave when he said he would or via the Section 21 / Section 8 route.  I can't see how you can get him out any other way at this stage.  Why didn't you give him a section 21 months ago?

As the tenant is 6 weeks in arrears, I think you can use Section 8 to evict him as that is one of the grounds for evicting. This should take a lot less than two months and by the time the Court gave you a date he would be at least two months in arrears which is the minimum period they should be in arrears.
