I issued s8 to my tenant for rent arrears and because I want to sell my house. They have got themselves a solicitor and a defence which is estimated at quite a few ££ which will take off the arrears aswell. The tenant has a surveyor going to the property and I have one going in may. I am looking at around September time for a court hearing again now.

My question is could I issue s21 now instead? Or will the tenants counterclaim still go ahead. I understand even with a s21 I'm still looking at august/September time for my property back.

There's nothing stopping you issuing a section 21 notice in parallel with your section 8 notice.
You can make two separate possession claims.

Yes.
They're completely separate processes.
