Statutory Periodic Tenancy

Hi

Does anyone have a version of a Statutory Periodic Tenancy form that I could use as a template,  as there's nothing available on this site.

I've got a guarantor form from this site, but I'm thinking of going forward with a Statutory Periodic Tenancy as my tenant has been living in the property for 5 years.

I'm happy to sell it but I'm unsure of the best time in these troubled financial times, I could obviously commit to a AST for 12 months but I'd like to look at my options, I'd like to provide my tenant with something in writing to ease their mind.

SPT is created when an AST expires, not something that is signed up to.

To be clearer: An SPT is created automatically when the fixed term of an AST expires.

If you do not issue a new AST, then the tenancy becomes an SPT with the same AST contract terms applying. If the tenant continues to pay rent and it is accepted by the landlord, the tenancy will continue month to month on a periodic, rolling basis.

Assuming the rent is paid monthly, for an SPT the tenant must give you at least one month's notice if they wish to quit.

Landlords can issue a section 21 notice as long as the tenant is given at least two months' notice.

Thanks tfor the replies, I've decided to do another 12 month AST, I got the forms from this site.
It looks like a very helpful place to educate myself on everything to do with being a landlord, although I've joint owned the properties for 15 years,the other owner did the paperwork side, now it's on me, fingers crossed.

Personally I prefer an SPT, gives me more flexibility and options.

It's much simpler not to have a series of agreements, but to let the tenancy become periodic and just roll.
All of my tenancies are periodic after an initial six months - and the government is planning to make all ASTs periodic from the start with no fixed terms at all.

I have had only periodic tenancies for years. I realised early on that at the time it was just another nice little earner for the LAs,getting a fee from me and the tenant.A periodic arrangement is much better for landlord and tenant. I am still learning things on here,and it costs me nothing!
