rent arrears after benefits stopped

Hi all,
tenant on renewed assured shorthold in receipt of housing benefit which covers the complete rent exactly. The rent is paid by the housing authority directly to us and we have had a reasonably good relationship with the tenant who has two children.

last month we had a note from the housing benefits office saying that the tenants housing benefit was supended (pending receipt of further information requested from her about her eldest 18 yr old child).

I sent a recorded delivery letter to her stating that the full rent would be due to be paid by her directly to me on the due date......also mentioning that should her benefit be partially reinstated then the balance would be owed by her to us.

the rent is due on monday ......Frankly I'm not expecting her to have it and I will of course check with the housing benefit office as to whether her benefits are to be (partially?) reinstated, before I call at the property for the rent.

The tenancy agreement states that "if any part of the rent is outstanding for 21 days after becoming due........the landlord may recover posession of the property and this agreement shall come to an end."

I plan to give her this attached letter on Monday if she a) doesnt have the rent or b) is not at home
any advice is welcome........also next steps ie wht we do if after 21 days she still doesnt pay

Can you explain why you give 1 month + 21 days notice ?

Sorry I havent been clear obviously.  8)

The rent is paid in arrears and next falls due on this coming Monday.  It is then that I propose to give the tenant "21 days notice in which to pay or I will seek posession of the property". if she doesnt pay of course.....the bit in quotes comes from the tenancy agreement

After the expiry of the 21 days notice, the rent will be 'overdue' for 21 days although like I said it is paid in arears.

Hope that clears things up.

oh, and where on here can I find the section 8 and 21 notices ???

Another 'technical point'

if the rent is paid 4 weekly in arrears, then am I right in saying that the section 8 "two months in arears" stipulation is satisfied  after two rent days are missed??? ie 4 weeks after the first missed rent

is there a template for the section 8 notice on here???
