Further to recent posts, and reluctantly, I've delivered the S21 form 6A to a long standing but recently non paying tenant. LegalforLandlords advised including recent copies of EPC, Gas and How to rent, but the tenancy is from 2013 so I was informed there was no obligation, just a recommendation in case the tenant refuses to co-operate ( Which I think will probably be the situation..)

Anyway, now I'm sitting here wondering what happens now so I thought I'd ask you bright sparks for any experiences and for potential steps to come..

I have no reply to the delivery, no response to the enclosed letter inviting discussion and, more annoyingly, no rent paid..

Worst case scenarios are welcome, but does anyone know the routine for non compliance and the time and rough costs involved.. it's difficult to relax knowing you don't know what is about to happen.. seems like Patience might be a virtue but being forewarned is always more useful.. any comments welcome as I'm just sitting around imagining the worst.. ::)

Thanks in advance..

Hi

see my post ( eviction taking so long )

I am currently using Legal for Landlords for evicting some tenants who have been non paying since Jan2019, it has been such a long process, we went with section 8 and the court issued a possession order and they still have not left even though they had to within 14 days .
basically they are now staying for free.  >:(

We have applied for baliffs and now awaiting that and been told a further 10 weeks.
Apparently because there is a housing crisis ,  the case wasn't passed to the high courts ( which gives a baliff date faster ) which means the tenants live for free and the landlord suffers, :(

You will be able to access the costs on the L for L website. it isn't cheap but will be needed to do it officially :(
!you will need a lot of patience as we have been chasing this since Jan , we had to wait a full 2 months rent arrears before issuing section 8 which took us to march 2019. Then applying to court etc .........

good luck.

I'm sorry to hear that. I understand the Section 8 is a different process to mine but clearly there will be the delays expected with  an overloaded legal system and I'm prepared to go through the correct channels, but I'm still curious as to the experiences of others in a similar situation.

I hope you recover all of your expenses from the tenants and even if it means £1 a week forever I hope you will assert your rights as a landlord, minimal as they might seem.

Perhaps you can keep us updated on your progress..

Thanks for taking the time to discuss this, I hope you have a positive result soon.
