Hi

I am a new landlord that has decided to privately rent my property.
I currently have them on an assured shorthold tenancy which expires 31st March 2012.

I would like these tenants to leave the premises.

I'm trying to read around in order to get some advice as I really haven't a clue how to go about it or who to call for advice etc.

On the the original shorthold tenancy agreement I included the names of all tenants that were going to live in the home on the one agreement just in case of anything. I then extended this till the 31st March 2012.

From what I have read so far on the posts on here, I need to put there deposit into a protection scheme and then issue them with a section 21 form???? is that correct?

What protection scheme should I use ? does anyone have a link to the website of one?

Who's name should I issue the section 21 form too ? all on the tenants on one form as before? as this is

Please let me know if this is correct as the tenants are seeking advice and I have no one else to ask.

Any help would be appreciated

I would issue the section 21 notice to the main tenants named on your tenancy agreement.  I don't think you have to give a reason, other than saying that you just need the property back.  It would just mean that you are no longer willing to renew the tenancy.  I did it a few months ago to a tenant who had been an unreliable rent payer.

Do it soon though.  Landlords often have to give two months notice (check your agreement for details), and you say your tenancy agreement expires on 31st March 2012.

With regard to their deposit, by law you are supposed to have lodged this in its entirety with one of the officially recognised protection schemes within a couple of weeks of the commencement of the tenancy (give or take, to allow cheques time to clear etc.).  In the event of needing to evict, you could encounter problems if you have not done it.  Do correct me if I am wrong, but it sounds as if you have been unaware of this legislation (if I am reading you right), and may not have lodged it anywhere?  Done in error I am sure, but you do need to rectify it urgently, so that the tenants have no come-back on you.  Personally, I lodge all of mine with The Deposit Protection Service because it is free (other schemes have various charges).
