My tenants want to move as the tenants upstairs are noisy

Hello,

I am a landlord and wonder if anyone has some advice.

My tenants want to move out, as the neighbour upstairs is incredibly noisy. We have tried everything, left notes, talked politely face to face, but nothing has changed.This has been ongoing for years.

As a landlord, do I have any recourse to sue the landlord of the other flat?  I'd imagine I wouldn't be able to their tenant.  Or the freeholder for breach of the lease maybe?

I keep drawing blanks when I try to seek some answer for this problem.

You could try, the threat alone might just have some effect but I doubt it. The additional problem you face is that if you go down any formal route, should you ever wish to sell you would have to declare the nuisance. It might also be an issue for the other landlord of course, so it could be worth pointing out if he ever thinks of selling with this tenant in situ.

I had a situation where a neighbouring tenant was not just screaming all night and threatening mine, but was hacking at the shared gas pipes. My nice tenant grabbed his stuff and fled. The landlord, social worker and police refused to act, until the neighbour stabbed a total stranger in the street and ended up in a psychiatric prison. I lost a lot of rent over that.

Yeah I'm keeping my options open at this stage.

Yeah we haven't started a formal complaint. Just a note through the door so as long as nothing's traceable I'm not going to mention it if I sell. I know it's a bit naughty but hey. Apparently the new owners got 6 years or something if they find something out that you didn't declare.

Having been a landlord for some time I'm thinking of just jacking it all in. The mental strain of it all is too much.
