My Deposit

Hi all,

Before i start and ask a question, gotta say, great site :)

Here is my question, might need a answer in layman's terms :-[

I moved into a property in 15-07-07 via a private landlord and paid £1,000 deposit.

I am moving out into a new property on the 15-08-09.

I phoned my landlord today and said that i will be giving my months notice on the 15-07-09.

My main concern is the deposit right now, the estate agent (Charles Taylor Estates) does no longer exist.

I phoned my Landlord and said "What happens with my deposit" he replies "Did you give one" 5 second delay in the phone call "Oh yes, you gave a £1,000 deposit"... i than asked did you put it on the (tenancy deposit protection scheme) ..... he replied "What is that"

Am i stuck without anything coming back to me?

Hey jaykay,

He has acknowledged that you have given him a deposit, so that's good. He'll probably give it back to you. You have nothing to worry about, I believe.

If he doesn't repay your deposit, you can take him to court and get x3 the deposit because he failed to comply with the law and put the money into a scheme. I would threaten him with that if worst comes to worst.

I'm sure you'll be fine, to be honest. He didn't give you an indication of holding back the deposit, did he?

He is visiting me tomorrow so i will find out what he is gonna hold back.

My new estate agent said "If he tries to con you throw the Rent Deposit Scheme at him if he aint done it"

To be honest, i really like my landlord and would feel bad to thow that at him, but at the end on the day it is a case of my money and living :-\

Dont feel bad!

It is a business issue and if the LL is not professional in his business dealings then he/she does not deserve your 'feeling bad'.

It is your money - they should have sorted an independant inventory at the begining of the tenancy so you need to brush up on what is fair wear and tear and what is not so you dont get ripped off!

I have been thinking about it and now im thinking "Why should I feel bad" considering what type of Landlord he is, I.e what he has done for us..

Examples:

We had to fix the BT phone lines as he would not pay BT for it
We had to fix the lawn as it was unsuitable/dangerous for children
We had to pay for new locks because the previous residents still had keys for our property (I know this because I woke up early because of some noise and found the previous resident in our utility room, He said when I caught him "Sorry I was looking for something I think I left here when we moved"...hmmm
We had to sought out ALL of the previous residents red letters with the company's
When ever something broke down we had to phone the repair people because he could not be bothered to do it

The list is endless...

I suppose the only real good thing going for him is that he is a real nice down to earth person.

I was thinking about something, when we first moved in the sofa was brand new but just after one week it started tearing (think the material was some kinda soft plastic) so he bought us a new one, we he take the cost for the new one out of the deposit?

Another problem I have is that the new estate agent we are dealing with must have a reference from our landlord via letter, if I do throw the rent deposit scheme at him he might be nasty and write a bad reference.

At present he said once I receive the letter from the new estate agent he will write a letter to them saying you have been the best resident he has ever had etc etc.

Shall I wait for him to do the letter first and then mention the rent deposit scheme (if needed that is)

I have a feeling that he will try his damm hardest not to give us back our deposit due to the fact that he does not like parting with his money and is very very money orientated.

He was meant to visit us today but could not so his coming tomorrow.

This is so much fun!!!....lol

Did you get that in writing? If not do so!

Jaw jaw is always better than war war but only when you have it written down to use against the person in future.

Just be careful he does not try to say YOU are with holding rent! As I said, for your own protection, get it in writing!! Verbal agreements/contracts are very difficult to prove!
