who wants a chip shop next door?

Hi, new to the forum, looking for advice / help ?

My property was originally two buildings, at some time it was converted into one and used as a chip shop ( 25 + years ago), subsequently the property was then reconverted / subdivided back to two properties ( 20 years ago). I purchased the property about 14 years ago and subdivided the property into one distinct dwelling with a flying freehold ( entire roof & roof space) over my neighbours property. My neighbour has just applied for planning permission to convert his property back to a chip ship, do I have any rights as the owner of the  flying freeholder above the property?

You have the right register your opposition to the planning request.

You can't use any drop in value of your own property as an argument.
Focus on the anti-social, noise, litter, vermin - human and rat (and smell) of the proposed change in use.
And anything else you can think of - is the area nicer than it was, might people object to beef fat being used, or pork sausages being sold?

You might at worst, get the permission given with specific provisions about opening hours and keeping things tidy.
You might look like such a nightmare neighbour, the chippy decides to look elsewhere.
