Lacking proof for accelerated court procedure

Hi there

Would really appreciate some advice on this. I have been a landlord using an estate agent for a number of years and I have been wanting to sell that property for about a year. Gave the Section 21 notice in November last year and the tenant who initially agreed to leave has dug their heels in and isn't moving...

I have prepared the accelerated court procedure form but have the following gaps:

- The estate agent says that he did provide the How to Rent guide back in October 2015, but has no record to prove it
- The most recent gas certificate is provided, but so far despite chasing up it seems the agent does not have the historic ones

If I submit the form with these gaps, would it be an automatic rejection? Is there anything I can do to mitigate this? E.g. if the agent sent an email to confirm that they submitted the how to rent guide in Oct 2015, would that be considered proof ?
