My brother in laws ex tenants have verbally agreed to him keeping their deposit for many reasons but managing agents cannot get anything in writing to confirm this as the ex tenant won't answer emails or letters. How long can this go on for before he can get his money back?

Just start the repayment process, all to the Landlord, via the deposit protection scheme it's with... if the Tenants don't agree, you'll find out soon enough. Agent doesn't need 'instructions'.

When you apply to get the deposit back, and assuming the tenant plays prat and doesn't say its okay, it's 90 days from the end of the tenancy...
