I was after some advice..
My current tenant has not paid any rent for the  last three months and has asked to continue in this vein ( no payments or a small gesture ) for another six months where he thinks he may have some money coming to him in six months time ......and asked if I could wait....umm No....so I gave him the obligatory two months notice..he now won't pay another penny......I arranged a visit to the flat...the place is a state.. Covered in yellow from smoke even though he signed a No smoking clause in the AST .The  walls are covered in damp wallpaper coming off and carpets ruined....the list goes on....the bond will not even cover it .......can he stay  there up to the bitter end of two more months and not have to pay me a penny..just ruin the place even more in the meantime....
Very frustrated.....

If you've given 2 months notice for him to leave then no he cannot stay until the bitter end of that 2 month period, he can stay alot longer.  What 'notice' have you given him exactly?

Written notice that he needs to vacate the property after two months as thought this was the required period for an AST.
Wondered if I should hav served a section 8.

Thanks
