Re-register deposit

If my tenants wished to stay on after their AST has finished, do I have to re register the deposit (& pay the relevant fee) with TDS.  I haven't yet decided whether do have another AST or a Periodic Tenancy.   Any advice gratefully received.

From depositprotection who I use;

"If the fixed term tenancy has become periodic you will need to advise us that the tenancy status has become periodic.

If your tenant has signed a new fixed term you can renew the deposit. If you renew the deposit protection the tenancy start date will always be the tenancy end date of the previous tenancy.

Important note: If you do not take any action, the deposit will be automatically closed on the tenancy end date and will not be able to be reinstated"

And

"The fixed term tenancy has come to an end but the tenant(s) have signed up for a new fixed term, do I need to submit a new deposit?

No. You can simply renew the tenancy via your online account. To do this, find the deposit under 'View My Deposits' and click on 'Renew'.
The tenancy start date will be the end date of the previous tenancy, but you will be required to enter a new tenancy end date.

You will need to pay a new fee for renewing your deposit"

When you renew the deposit, I recommend you also re-serve the Scheme's Prescribed Information on the tenant to avoid any issues down the line under Superstrike v Rodrigues.

Hi Riptide,

Sorry for coming back so late!!   The deposit is registered with T D S.   (I hold my tenants deposits in a dedicated account myself).

It makes no difference which scheme by the looks of it.  A lovely money making scheme for someone!
