*** MOD EDIT ***

The poster has decided to lie and deceive people and is actually the tenant and not the landlord in this 'story'

*** MOD EDIT ***
[/size]

I have recently let my property through a letting agent.
I left some items in the garage.  Mostly my tools, a compressor, old records and few gas bottles that were too heavy to store elsewhere.
I didn't disclose this to my incoming tenant, but they did know that there was stuff in the garage.  I told the agent I would remove some of the stuff, and I arranged for a lot of it to be moved, but left the big heavy stuff, leaving the garage about half full.
The tenant was under the impression it was all being moved.  The agent had told him the garage was being emptied at 10am on the day they moved in.
I'd sent someone round to move the small stuff but left the big stuff.  When the tenant got there the garage wasn't empty, but a lot had gone.  They called the agent to complain and the agent said they would get in touch with me, but I wasn't available.
It appears the tenant has emptied all of my belongings out of the garage onto the side of the driveway, telling the agents they would do that for me to collect, as they had been granted vacant possession of the property and it wasn't vacant with my stuff in it.
The agent didn't tell me and I've found out this morning.  I have nowhere else to store the items which have now been outside in the wet for two days.  A lot of the stuff, like my electrical equipment, will be ruined.  The garage is full of my new tenants stuff.

I've got to move the stuff and put it in storage, but can I bill the tenant or the agent for this?

And if I don't move it and it gets stolen or damaged, or the tenant gets rid of it, can I sue them.?

Hippogriff

No chance. You're cheeky to even consider. You don't leave your stuff behind. They rented the house and garage... they have exclusive rights to it. If they were kind enough to store your old tat for you, you should be offering a rent reduction. You can try get satisfaction from the Agent, but not the Tenant... they made the Agent aware.

Martha

I can't get my head around why you think you have rights to store your property in someone else's space.

The problem was your failure to remove it.  Stop pointing the finger and look a little closer to home.

Riptide

Unbelievable Jeff.

You rent a place out and the tenants don't want other peoples stuff in their home.

The above, edited quote sounds right.

Was this a permanent non existent agreement you had?  Normally you'd say verbal agreements aren't worth the paper they're written on but you didn't even have one.  Why on earth do you think a rent paying tenant would store your old records and gas bottles?

TDA

Crass stupidlity, or the OP is a wind up....... :-\

Allybops

When you rent a property out you in effect are signing over the ownership of your house for a set period of time. So effectively your stuff was in someone else's garage.

MallyB

You should have let the property but not the garage and put that in the agreement. We've done this before with no problem as long as you're upfront so everyone is aware.

I think TDA is on the money here, This has to be a windup.

Platypus

Thanks for your replies guys.
This is not a wind up.
I am actually the tenant and just wondered how landlords felt about this, given my current landlord has stipulated he has every right to leave his stuff in the house an I can do nothing abut it.  Furthermore the agents Frank Innes are saying that I am not allowed to get rid of the items.  I could not believe this would be true so wanted to check.

I have actually taken legal advice now and so understand that it is not permitted and the landlord has breached the lease by not providing vacant possession.  But interesting to hear you guys.

Thanks for the feedback

You're obviously not a straight kind of guy and felt the need to lie to get a response from random strangers.  I'm definitely not a fan of yours.

You would have got the same answers if you played it straight, you have trust issues.

Hippogriff

I, on the other hand, enjoy being misled and played.

My comment wouldn't have been any different.

Martha

Hmmm since my trust for you (OP) is now at an all time low, I am not sure whether I can trust you when you tell us you are the tenant ?  Perhaps you are a third party... or just a bored troll ?

jameds

I knew this wasn't a genuine/truthful op. My advice to the op is if you want good advice in future then perhaps you shouldn't be telling lies. Pathetic really.
