Urgent. Suspension of eviction

Hi can anyone please advise, tenant has applies for suspension of eviction and hearing is tomorrow.  Normal section 21 route has been used.  However in the mean time tenant has been arrested for harrasment to landlord on several occasions and is currently on police bail not to come near landlord or property he lives in.  Landlord also has crime number of police investigation.  I am sure tenant will claim hardship as she is pregnant at hearing.  Will my case be strong enough if i show police case and non payment of rent formthe last two month... Please can you kindly help.

Always do your own research

A section 21 does not require the Landlord to provide any reason for seeking a posession order so you do not need to bolster your case from that point of view.  However the judge has scope to stay the possesion order for up to 42 days which a pregnant tenant will always seek.  It is at this point in the hearing that you should raise the ASBO type issues and how you "fear for my own safety".  Non payment of rent might help a bit but strictly speaking it isn't necessary or correct as you are not seeking a possesion order for late rent.

Go to court in a smart suit, don't be nervous, take your paperwork with you including the police reports.  You should be good.
