I have inherited a property which already has tenants. There is an agent, which the previous Landlord used, who collects the rent etc. I have not signed a new tenancy agreement or any other agreement with them. I now need the tenants to vacate as there are a lot of repairs that need to be done to the house. Can I give them two months notice or will the lack of an agreement cause a major problem. Thank You.

If the agents are still collecting the rent, presumably you are paying them for this service so why not ask them to serve the notice?

The agreement with the dead person, will transfer to you.

You need to find out what agreement they have. If its an old one, you got issues my friend, for which you will need professional help with.

If its an AST, you just need to let the agent know, you want them out as soon as you can legally, this could be up to say 12 months, but as you say shortest is two.

Then hope they leave and you dont have to evict

There is a special notice that you have to give informing them that you are the new landlord.

Thank you all for the info, as you may have guessed this is all new to me. it was a real surprise to be left this property but I had no idea what a head ache it could turn out to be. I have read loads of your comments on  many different matters,& think I have learnt a lot from them, mostly not to get to friendly with the tenants, which I thank you for. I will take your advice & get the agent to deal with it.
