SMF - Just Installed!

We live in Germany (Hubby in Army) and we have just been informed last Thursday we are moving back to the UK. We had a tenant lined up to move into our property the same day our old tenant moves out (26th April) but we now want to move in the property ourselves. The new tenant has signed the tenancy agreement (after being told we wanted to move in) but neither us or our management company has signed the agreement. Is the contract still binding? The new tenant is threatening us with court action but has since told our management company that he will settle for financial compensation! We received the contract on Thursday lunch time and we advised the management company we wanted to move in late afternoon on the same day. We clarified via email with the management company that their would be no consequences to us if we pulled out of the agreement to which now they are saying they thought we meant financially not legally. Can anyone help? This seems such a grey area and their solicitor is quoting us £210 just to look into it.

If you have not signed, then I cannot see that you have a binding contract, I hope that your agent has not let them move in.

Was a verbal contract made? hope not, it could be binding. a solicitor is best.
