I've begun the process of selling one of my rentals, the agent says they do not have to advertise the fact that there's a "tenant in situ" on the listing & wish it advertise it as a normal listing or that vacant possession on completion is stated. Could this be seen as misleading advertisement.

Unless you or the agent has some way of making vacant possession possible, yes.

Why on earth would they waste everyone's time doing this? In the past couple of weeks every agent I have ever dealt with over 20+ years has emailed me with "Great investment opportunity", numerous properties with tenant in situ.All give the rent,and the expected yield. There is a lot of competition.I would personally never sell or buy a property with a tenant.

Thanks for the reply's, I think it's a deceptive move by the agent & I'm not entertaining it at all. Desperate times but I'm not being dragged in. They're trying to get anyone through the door, I'm actually buying another one & no mention by the selling EA about funding, I bought one just after Covid & the agent was as picky as a Ferrari consultant sales executive 😂
