Eviction process!!

Hi guys, I currently have tenants in my property they've been in there for about 3 years brilliant tenants never damaged the property never been late or missed a payment I have been giving them 6 months tenancy agreements through out the 3 years and I feel so bad giving them a section 21 form :( and this is we're you guys come in, there tenancy started on 1st October 2011 and to my calculation it will end on the 1st may 2012, now is the serve date the date I send the section 21????.... And is the expiry date the 1st may????

I'm giving them the notice the first week in feb which is more than enough time for them to find somewhere else.

Help on this matter would be much appreciated.

I think you only need to give 2 months notice for a section 21 notice, though could stand corrected.  You are gving them generous notice, which should be OK.

I would be much like you if I needed to serve notice on a good tenant.  I wouldn't like doing it.

Hi Topseyt, yes it is 2 months notice, it's just the expiry date of the notice I'm not to sure about, there tenancy ends on the 1st of may so is that the expiry date I put on? Or do I put the last day of April?

Hi if it's a AST fixed tenancy 6mths it has to 2 months notice, in form of S21.
You can serve an S21 any time into a 6month notice the more notice ideally you can give them the better to prepare anywhere frm  4mth process  this would then end bang on the end of the last day of tenancy enabling them to checkout of the property that day. so I would work back from the end date of tenancy by 8 wks & put that date on it as thats when it would legally kick in hope it helps good website for free download forms s21 & s8 is is my bad apple.com Thanku

The expiry date is CRUCIAL to get right. As far as I understand it, it must say that the section 21 notice expires AFTER XX/XX/XXXX with this date being the 6month/12month anniversary of the 'contract' and this date must be at least 2 months from the date of delivery.

Hope that makes sense. Hundreds if not thousands of pounds hang on getting this right, so I recommend you triple-check this prior to sending it off.

Armin is right, make sure 100% that you get the dates right or it could cost you money. However, sounds like you have a nice relationship with these tenants so it might not be a big problem. You can buy S21 notices online with guidance notes etc. Try this one: http://www.lawpack.co.uk/landlord-and-tenancy/tenancy-agreements/item3806.asp?source=pl2mv it's about £15 and includes eviction notices, guidance, and also a solicitor approved tenancy agreement (you might need this again!)

But to recap - Armin is right, be 100% certain!
