Eviction of tenants

Dear Members

I really hope you can help,
I have a rental house that was supposed to be a investment for the future and is slowly turning into a tenant nightmare.

Let me explain i have a 2 bed house, the rent was £1313.00 the tenant moved in on 24/4//17 and i have received hardly any rent about £1100 of the rent that was due.

obviously with having the mortgage to pay this is a huge drain on me financially.

I informed the tenants that i would be evicting them and after as much research as possible i sent them a form 6a with 14 days notice?

Im not sure that this is correct... I'm on maternity leave at the moment and cant afford huge legal costs. I really want this resolved before baby is born as the stress is horrible!

My question is what do i do?

could someone give me a idiots guide to eviction.

I have proof they did not pay the rent nor are they eligible for housing benefit.

to top it all off they went on holiday for a month i was told by neighbors and i cant contact them.

Any advice is appreciated

How long was the initial tenancy period?

Your form 6a is not correct and the notice period of a correct eviction notice is 2 months. 

You need to issue a section 8 notice.  If they don't leave after the expiry of that notice you then take the case to court to obtain a possession order.

Did they pay a deposit?

Hi it was a shorthold assured tenanacy for 2 years
They were referred by Brent Council who said they had done checks on the tenant who were eligible for £1313.00 in benefit.

No deposit was taken.

Do you have any links to where I can get a section 8 notice?

And subsequently how I can process a court order. Funds are limited and if I can avoid solicitor costs I would try.

Do you recommend I use a solicitor? I've never been in such a bad situation.

2 years!!!!!  In future 6 month contracts only then allow the tenancy to roll onto a SPT.

Are the council involved with these tenants other than referring them?  Can the shoulder some responsibility?

Yes the council requested a 2 year tenancy.
The tenancy agreement only shows 6 months however.

The council said it's just a referral scheme they won't shoulder any responsibility.
There was nothing in writing either.

Hi your tenants need to be 2 months in arrears before you can serve a section 8 notice and you need to show that you have discussed ways in which they can repay the debt.  YOu can find section 8 notices on the government web site free.   Use the PCOL system to get an Order of Possession once the section 8 notice has been served.   its cheaper and quicker.  But everything in Law take ages.
