Hello, this is my 1st post, I'd be really grateful for any thoughts on the following please:

Our nightmare tenant is finally due to be evicted by the bailiffs in late June. It has been a loooong & harrowing road.

The tenant owes us money (rent, mounting court & bailiff costs) and has also done some damage to the property. Does anyone have experience of what happens to the tenancy deposit after eviction?

I believe the period of her 'unofficial/unwanted' occupation is bound by the details of her original contract, ie if she has not paid some of the rent/left unpaid court charges relating to the tenancy, these can be deducted from her tenancy deposit without much hassle? But I also know the tenant & landlord have to agree about any deductions, so does this need for agreement change if the tenant has been evicted?

Another question, will we still have to arrange and pay for a check-out clerk to come & document the damage she has done? Seems just another pointless fee to be paid (originally a fee she was supposed to pay under the original terms her tenancy agreement).

Im told anecdotally that after eviction, we're legally obliged to store the tenant's belongings until she wants them back. Is there any time limit on this? or rules about where we have to store them? (she's got tonnes of junk & im dreading having to put it all in a facility that she never bothers to reclaim it from & paying an arm & a leg for the privilege for decades)

Thanks in advance for any answers or thoughts on this and also for taking the time to read all this.

Hi  when the tenants get evicted they are givin a hour to remove there stuff if court bailiffs they would have been given time and date for this to happen so should have moved all there items, if high court enforcement no notice is given and they are given a hour to collect personal items i.e. Medication documents over night bag etc. The property is secured i.e. Locks changed, as for there stuff you as a landlord don't have to give set time but normally it's a week and the tenant will contact you to arrange collection. The deposit the tenant will request this when left the property and you need to respond within ten days giving breakdown of  deductions and financial lost, in most cases of rent arrears eviction they don't normally contact the landlord. Hope this helps

Depending on where you have secured the tenants deposit it is possible for you to request for the deposit to be returned minus any payments due.  They the tenants get a right to have their say.

Can I ask you how long it took between applying to Court for Warrant of Possession and the bailiffs turning up?
