Evicted tenants

Hi All.  We have legally evicted 2 tenants from our flats.  They had a van on the day of eviction but only took clothing.  We arranged to give access to our property 2 weeks later so they could remove their belongings.  They were aggressive so the police were present.  They asked us to leave and return after the allocated time. We returned within an hour.  Everyone had left, the property was left unsecure. They had caused more damage to our property and apart from a small dressing table, had still left everything behind. Solicitor says we need to issue a formal notice.  I say we have gone past this.. Any advise would be appreciated!   Sally

Did you have a possession order with locksmith present?

Yes, all legal through the court.  Bailiff and locksmith present on eviction day.

The formal notice that the solicitor is talking about is probably a tort notice. Which is what you need to do when you have a abandoned property you find yourself responsible for.

Never (ever) allow an evicted tenant back into the repossessed property. That's an act of absolute madness.

The tort notice will give the tenant x days to arrange to collect their belongings from outside the property otherwise they'll be disposed of. The solicitor should be able to help with the notice. You pass things out to them.

As you've let the tenants back in, I'd change all the locks again (and check the window locks) and have a good look around to see what else they might've left.

You can take them to court for vandalism of private property.
