New user / agency question

Hello all

new user!! hello everyone had a look around.... what a fantastic forum really good information !.

A question?

I have a tenant in a property (a flat) that I own, however the agency I use have decided to fold up and transfer there business over to another.

The agent whom was running the Previous agency works for the new agency also.

I have been offered a new contract to sign and have a good tenant in the property, however I  now want to let it directly to him  as  have doubts over the new agency and feel that much of the work is something I either currently do or am capable of.

Where does this leave me legally?, am I leaving myself open in any way and where does this leave the deposit as the tenant will have paid this into the TDS scheme.

Any advice welcome but I am determined to let to let it myself!

I can't see how the original agreement between you and the folded company can still be in existence so from my point of view there would be nothing wrong with you keeping the tenant. I presume the deposit is under the agents name? Do you know which scheme it's under, if you do a call to that company would tell you the best way of securing the 'new' deposit as I'm sure they'd have seen this many times before. I'd start a new AST with the tenant aswell.
