Can I get my referencing fees returned?? PLEASE HELP!!

My partner and found a property an payed the referencing fees, they called me yesterday morning to say that the tenants in the flat we had chosen had extended their tenancy for another week, which meant we could not move in as my tenancy ran out sooner and I'd already requested an extension on it.
I then found a new flat and so called the agency this today to get my fees back, they then to me that the tenants have agreed to move out on the original date. They knew this yesterday morning but neglected to contact me and only told me once I called to request my money to be refunded, and in this time I have found a new property, do I have a leg to stand on in regards to getting the referencing fees back now? As technically it would now be me pulling out of the property, but I don't feel it's fair that they didn't bother contacting me straight away.

You're probably up the creek without a paddle here, sadly.

Check if they are registered with an ombudsman, nals etc and if so, complain.  Tell the agent you intend to do that first and it may prompt them to refund you as they won't want to be investigated.

I am an agent, I wouldn't ever do this to someone so not so 'typical' and certainly not a reflection of all of us.
