Tenant refusing access

Hi
I am going to evict my tenant under a section 21. I have been trying to sell the property with her consideration in mind but now never answer my requests for viewings. She is also in rent arrears. But she is not communicating at all. I suspect she wants eviction then to apply for a council property. But my reason for being here is 2 fold. I know the first point is my fault but I only last week put the deposit in a deposit protection scheme. Does this matter if I have to apply to the court for eviction because I thought I read somewhere that the deposit has to go in the scheme within 30 days of the tenancy starting. The tenancy is 3 years old.

I also need to isuue her with an energy performance certificate to apply for a section 21 but she is not responding to my requests. I have given the 7 days written notice with proof of delivery as it states in my lease for 7 days access to inspect but with no response. I dont know how I stand with this. I put in the letter that the EPC is a statutory obligation on my behalf and need to do one.

I have a gas safety certificate and issued the governmentt guide how to let.

You need to establish a dialogue with your tenant.  Be very honest with her.  Find out what she wants.  If she genuinely wants to be evicted in order to get social housing, then you may be able to agree with her that it's in her best interests to "forget" that you failed to protect the deposit and omit to mention this point to the Council or the judge.

If she doesn't want to be evicted then I'm afraid you'll end up paying her a considerable amount of money.

i think you are going to need a court order to get her out, as you didnt put the bond in a scheme in time,
