Deposit Protection and dodgy agents

Hi,

I moved into a property in September and my landlord protected the deposit late and that only after I kept on asking him whether it has been protected or not. I also asked for Prescribed Information which he has not forwarded to me. My name is spelt wrong with DPS and despite several reminders he has not had it corrected.

Now he is selling the flat and viewings are taking place. From my research it appears that my contract will remain unaffected, however will the new LL take on the responsibility for not having the dep protected on time and not issuing the prescribed information?

Also, the agents the LL used didnt provide us with a proper contract. On the day we moved in they made us sign a new contract and said they would get back to us with a copy after getting signatures from the LL. This didnt come through. I kept on asking the LL and the LA and then a month later the LA sent me a contract which was basically a spliced together PDF of the original contract I had signed and the contract I signed on the day I moved in. Surely this cannot be right?

So you are complaining about spelling and "technicalities"

Your deposit is protected.

You are enjoying living in the flat.

You can smell a deposit x 3 compo claim???

Get in!

Enjoy it, you'll increase the rent for others and make the quality of rental stock worse, but you get in my son, fill your boots.

Nope not at all, not intending to take anyone to court for the 3X penalty. The landlord has not kept me informed about what's going on. He does not respond to emails or picks up the phone and has told the estate agent who is showing people around that we are leaving in 6 weeks time. I just want to know where I stand.

Well he needs to give you two months notice.

It is entirely fair that you should have these matters addressed in a professional way.

Give him a ring, have a chat, see where you stand. It may be that he is holding off on notice on the basis a new buyer would actually want a tenant in situ. If that is the case he should have the good grace to explain it to you.
