My tenant lied about deposit

Hi all
I have a tenant who lied on the application form and fraudulently concocted a bank screen confirming deposit paid - it was a lie. My question is a lawyer is telling me I have to pay tenants deposit into the deposit scheme from my own personal funds to complete the "process" of ast to help with and secure a successful eviction- is this true?

Unless the tenancy is less than thirty days old, that wouldn't seem to achieve anything useful that would help with an eviction. However, there's not a lot of point paying a solicitor to help you with a possession claim and then not doing what they advise.

I suspect some wires have got crossed somewhere, though, as that advice doesn't make sense as stated.

Surely you just need the opposing screen showing it was not received? If no Deposit was paid then you haven't taken one. QED.

How do you know what was written was untrue?

Contact you bank and present them with the 'evidence' that the a transfer was made to your account.
Ask them to investigate why your account has not been credited.

They should contact the tenant's bank and this will either show that it was a system fault or conclusively prove that the tenant did concoct the screen.
