My stepson moved into a private property with his girlfriend and daughter. They paid 1 month rent in advance plus £800 deposit. They signed a 6 month tenancy agreement. Within the month she moved out leaving him to continue with the rent on his own which he cannot afford. Her father went as guarantor for them both. She is now demanding her deposit back. Is she entitled and should she contribute to the rent owing for 6 months as she moved out and they both signed the contract. I think it's unfair on him as they both went into this agreement with their eyes wide open. Any thoughts would be greatly appreciated as it's getting to the point where myself and my partner are having to help him with his rent which we cannot afford to keep doing. Thanks for looking

The 2 Tenants are jointly and severally liable for the rent. If the departed Tenant will not pay then the Guarantor should be chased. The remaining Tenant must pay the entirety of the rent in the meantime, though, they don't get to just pay 50% and leave the Landlord to chase the other 50%. The Tenant who has left does not get their deposit back like they want. No, they are not entitled.

So am I right in saying she should be also paying the rent even though she moved out? Thank you
