Late deposit protection

Hi, we rented a property in Scotland for 18 months and 3 months after the tenancy ended we still hadn't received our deposit back despite chasing for it. The landlord had claimed it was protected but when I contacted the scheme, it wasn't. It was only after I refused to give my bank details for it to be repaid directly (as I disputed the amount) that it was then immediately protected. This was 2 years after it was initially paid. We have submitted a case to the first tier tribunal but was just wondering whether you think it is likely we would be awarded a claim and potentially how much - would it be late enough for the whole 3x?

Sounds like your landlord doesn't have a leg to stand on...3x may well be possible.

Your case will succeed, but no-one can predict how much the penalty will be as there aren't prescriptive guidelines (that I am aware of)... but it will be at least 1x, at most 3x and possibly 2x. All that said... if there is a still a communication channel open with the Landlord... you can still reach an agreement and cancel everything (if that suits you by removing uncertainty). A letter outlining your sure win might prick up ears. No-one likes uncertainty.
