Good afternoon everyone, I'm looking for some advice please.
Mu daughter moved into an apartment 4 yrs ago. A new landlord purchased the apartment and she signed a basic tenancy but he didn't ask for a deposit.
She's been under him for the last 18mths, but now he has stated she has to pay a £1000 deposit or she will be evicted in 3 weeks time. Unfortunately she can't afford to pay this in one go. She's never missed a payment and for him to just spring it on her 18mths after not requiring a deposit seems very harsh and underhand.
She will pay the deposit but just needs time to get it together.
My question is, can he ask for this and if so should she be given some grace to make the payment

Thank you

No,this is nonsense. You don't mention the amount she pays, but he cannot request more than 5 weeks rent as a deposit.Even if he serves her with a S21 no fault eviction before May 1st,she will get 2 months notice, and even then does not have to move out until he gets a possesion order.I am sure any court would be on her side.In her position I would not pay this sum.He does not sound like the sort of person who would protect it.

I would advise her to contact the CAB for free advice.

What happened to the deposit (if any) that she paid to the previous landlord?

There's a big difference between there being a new requirement for a deposit introduced after four years (or eighteen months) and being asked to pay a deposit that was previously agreed but not paid. Either interpretation seems possible in the first post.

In both cases, it's not possible for a landlord to evict a tenant in three weeks (or to do so without a court order unless the tenant agrees to leave). So that's true either way.
