Help required!!

Hi,

I have a HMO, doesn't need a licence - all checked with local authority.  In one of the rooms I have rented, i forgot to register the deposit. I need to vacate this person as he is affecting the dynamics and harmony of the house.  Several things have happened causing damage to the property and I suspect it is him but have no proof.  The tenant is on a 12 month AST.  Can I issue a Section 21...what are my rights?  An agent told me i should have a lodging agreement not AST but he is not my lodger. Another agent said I can return his deposit and issue section 21.....I am confused...Please help!

I cannot afford to keep up with the deliberate damages to the property.

Any advice would be great as I am currently receiving conflicting information!!

I usually include the above disclaimer to remind folks nobody on here is a judge but perhaps I should start with "Never take advice from an agent" in the first line.  I assume you do not live in the property? If not then no lodger argument can be used.

You need to return the deposit (get written confirmation the deposit has been received by the tenant) and then serve a section 21.
Note the tenant can now claim through the courts a further sum of up to three times the deposit from you..
