5th month of our tenancy , deposit not protected. We didn't even realize landlord has to do that in 30 days. If he will pay , can we still get back 3 months ammount from him as he did it so late and kept our money unprotected for such a long time?

I am pretty sure you need to do this at the end of the tenancy. It is up to 3 times the deposit back, not a guarantee.

You can sue during the tenancy. Whether you really want to annoy the landlord while you're still living there is a question for youself.

The penalty is between one and three times the amount of the deposit in England and Wales. I think it's up to three times the deposit in Scotland, i.e. the court can award zero though that's unlikely if it wasn't protected at all.
