Dear Friends,

I am just writing my own experience regarding my ex-landlord.

My ex-landlord and his father argued to me last year 25th May 2018.  I and my other female housemate always politely tell his father, we are too many people (9 housemates, 8 room, 2 toilets and 2 kitchens) so sometimes we don't get a chance morning time to go to the bathroom, but he never pays attention to our matters.

On the 25th of May 2018, his father was already angry for different reasons, and I just discussed this matter. He told me that some of the housemate complaint about me (that guy left 2 weeks ago and he never has an issue with me) then I said that okay call him and turn on the speaker and I want to listen from his mouth. When I said this, he became angrier and told me that ' I am giving you 3 days to leave the house and my female housemate too. I told him, I want a proper notice not oral. On the next day, his son came to the house, and he left the 1-month notice for me.  I asked Citizen Advice, and they told me that, this is not proper notice. He should serve you section 8 or 21. Anyway, I called Council and reported the house issues (too many people live inside the house etc.)

Council told me that, they informed the landlord about their arrival day. My ex-landlord was texting me very harassing and bullying for example 'he was accusing me I am very violent with other housemates'

The council officer came 6th June 2018, but 2 days before, my ex-landlord was threatening me to leave the house; otherwise, he will throw my bags etc. I did not pay the rent because his father (25th May) when gave me a notice. I asked him will you return my deposit back? And he said to me 'I will break your leg if you ask any money' so that's why I did not pay the rent.

I was feeling very insecure and could not sleep well. I decided to move to Airbnb and when the Council officer comes, then enter the house. I never returned back the house/room keys. When the officer arrived, he tried to enter the house, but his father forcibly did not allow me to enter. He did all these things in front of the Officer. His father also told him and me, the landlord has changed the room key and he is not welcome here anymore.

I would like to ask some questions if you are my position what would you do?

1-He never returned my deposit (I gave him cash 1-month rent, and 1-time deposit & his father signed).
2- Council fined him 30,000 GBP (25000 HMO & 5000 health & safety)
3- Can I go small claim court or repayment order (I left the house since 5th June 2018, left London because no place to live & also left my PT job.
4- How much can I claim from him?

I understand that I wrote too much and please forgive me.

This is ringing a bell.I think your landlord might have posted something on the Landlord's questions within the past month or so.If you spot it,I seem to recall he is being sued by some other tenants because he failed to protect the deposit.If this is the same person,you are entitled to your deposit plus at least the same amount on top.Shelter or Citizen's Advice would give you the necessary information to recover your money.Good Luck.

I would like to know shall I go to a small court claim after 11 months? or is there any time limit?

You have still got time to go to court.If it is the deposit that you are pursuing, you have up to 7 years.Good Luck.
