potential landlord has not returned my holding deposit

I recently paid £2000 holding deposit to a potential landlord. When I was due to move into the bedsit I discovered tenants were still living there. I asked the landlord to return my holding deposit and he told me he had spent it. He agreed to pay me within 10 days which he has not honoured. I paid by BACS and I have a signed receipt from the landlord.  I would appreciate your advice and if you would inform me of  my legal rights .

I would - personally - be giving some serious consideration to calling the Police. A holding deposit is not for spending, that's outrageous. I am not sure whether the Police would help you, but they might provide some clarity for you. I struggle to see how this money has not been stolen from you. I do not know if this is good advice, but it might be an avenue for you to consider.

Firstly it is not a police matter, and they are unlikely to provide any clarity whatsoever.

Is this man the landlord or is he an agent? If he is in-fact the landlord, and you are not going to move in to the bed sit, my advice is; tell him that you will start proceedings with a view to sticking a charge on the property he owns.

Check to see if he is a director of any company. I can think of all sorts of legal mischief you can create. let me know

When this landlord has not valued your time or efforts, I think you need to give him a legal punch. The tenant law is very much in favor of you and you are entitled to take many actions against him. First thing, serve him a notice, this will really ruffle him up.
