Hello guys just wondering if anyone can help I have been informed that a property built in 1995, (a house with two flats) that the upstairs tenants should by law have access to the garden down stairs. Its news to me, just wondered if I should look into this further.

If the building is divided into two flats, it's most likely on a leasehold basis.  Check the lease.  This will tell if the upstairs leaseholder has access to the "downstairs" garden.

There is no general rule which applies.  Each lease can be, and is, different.
