agent refused transfer of deposit to landlord when requested by dps

Hi all the dps have contacted the agent who has lodged the deposit in the dps and have responded:
"we confirm that the current listed managing agent has responded to our communication.
They have indicated to us that they do not agree to the request for the transfer. Therefore, you will need to contact the current listed managing agent directly in order to complete the transfer or Repayment process and/or seek your own independent legal advice.
I have already requested the agent transfer the deposit to my DPS account ID before I escalated it to the DPS.  I sent the DPS all my proof of ownership etc and they still cant do anything which I find very hard to believe.  Both tenants are still living at the property but one is hoping to find something bigger.  Does anyone have any further advice?
I have no contract with the agent and have never signed any declaration to state he could lodge this deposit on my behalf in the first place.

Here is the sequence of events.
a month ago I terminated the services of the agent who was not doing the job.
Wrote an email to the agent telling him to transfer deposit etc giving my DPS ID no
Did not here nothing for a few days
Enquired with DPS in regards to what I could do if the agent did not respond
DPS requested proof of ownership etc and said they would request agent transfer deposit
Agent refused to transfer deposit to landlord when dps contacted him
