ASSURED TENANCY AGREEMENT - NOT RENEWED

Hi, My short term assured tenancy agreement expired 4 months agao, I carried on paying my rent. My landlord sent me a new agreement last week, but he has back dated the agreement. He is also asking for the rent increase to be backdated. Is he within his rights to do this?

Hello Itsme,

At the end of your original agreement your tenancy moved onto a Statutory Periodic tenancy because it was not cancelled.  This means the same terms and conditions roll over until either you or the landlord give notice to the other that you want to bring it to an end.

You can decide to mutually surrender the existing agreement and immediately replace it with a new AST, but do this only if the new agreement is entirely to your satisfaction.  I would suggest you don't accept a back-dated agreement.

I would slao suggest he puts his rent increase up his bottom, but you should be more polite than I have been.  He missed the opportunity to increase the rent six months ago, the t@@t.  If he wants to increase the rent in the future then he has to do so using a form where the content is legally prescribed.  See The Landlord's blog ... http://www.propertyinvestmentproject.co.uk/blog/notice-of-rent-increase-form/

I like to see the best in people, so I wonder if your landlord is a bit of an amateur.  But anyone who tries to back-date a rent increase is either an abusive landlord or so ignorant of other people as to make no difference.  So take care how you handle this piece of dirt in case he turns nasty.
