Hello, this might be an easy one but I am looking for advice. My tenant had a leak before Christmas in the toilet. I was notified and told it was not a major one. It got fixed but now the lady that lives on the flat below noticed a stain on the ceiling. I had a plumber to have look at it and at the bathroom too, There's no leak now and it's clear that it's the legacy of what happened before as the stain on the ceiling is dry. I have also been there myself and with the plumber, we have noticed signs of dump on the walls of the bathroom. Clearly, a lot of water went on the floor at the time and I was not told. Also, I don't believe the service valve of the toilet started leaking badly without have been tampered with. I am not sure If I can get the tenant to pay for the decorating, shall I? Thanks a million

Do you think this is enough proof to back-up your belief? The answer is, obviously?, no. The Tenant is not responsible for the effects arising from leaks that start in property you own. They are, however, responsible for telling you about it when they become aware of it... it seems they did that. Can you get the Tenant to pay? It all depends on how much of a bully you are (not accusing you of being, let's say "persuasive" instead) and how meek they are, I suppose. Morally-speaking I would say "no, and you should not even try, just take it on the chin" but you may think about this all very differently to me, of course.
