I used Landlord action to serve a S21 on my tenant who should of left in Feb and then they got me a possession order in mid May when he didn't go but yesterday I got a date from the bailiffs for July the 3rd for the T to be evicted.

Today he called me kicking off saying he needs until the 19th otherwise he is just not going and that he is going to court on Monday to delay the eviction.  Can he do that do you think or is he just venting as he knows his time is up?

Just want him gone

He can try right up to the bailiffs arrive at the door for eviction. Whether he will be successful is a very different question.

why not say verbally yes ok , then just turn up with bailiffs on the 3rd
if he thinks he's ok he wont have a reason to go court
you just deny saying anything on the day

Got hold of my solicitor and he has said not to panic.  He said there is always a chance he could delay it up to 42 days but that starts from when the order was made.  So if I was very unlucky he said the 9th of July at the latest it could be delayed but seeing as the tenant has put in a defense at the possesion stage it prob won't happen.
