I need advice on suing my estate agent who has refused to hand over my property to me and is retaining the rental proceeds. Can anyone recommend a good legal firm which can pass on the cost of their services to the agent?

It is a letting and management contract. The agent rented the property to a social housing company for a fixed 5 years term. He said he has not been able to increase the rent and sometimes does not receive rental payments for months.

I informed him in February that I want my property back. I wrote to him in March, April, May, June and this month but he has been silent.

You need to give much more information before anyone can respond.What type of contract do you have with them,and what are the circumstances that led to this conflict ?

This is a very tricky arrangement that you got into. Is the contract that you have with your tenant (ie.the letting agent) also a 5 year commercial contract ? If they are telling the truth,they should have grounds to evict the housing association.This still leaves the people residing in the house, who may not be willing or able to move.You don't mention what part of the country you are in.The Law Society may provide you with a list of solicitors who specialise in such cases.You cannot assume that your legal costs will be awarded to you if it ends up in court.
