Hi All.....

I have a question related to furniture....

I rented my flat out 10 months ago as furnished, leaving my furniture there. I have recently served a section 21 to my tenants giving them 2 months notice to leave but I don't think they are planning on leaving until they are forced to which could take up to 5 months from what I've heard, and I am going to lose my current accommodation soon so will have to rent somewhere myself.

Once the assured short hold tenancy ends and becomes a periodic tenancy, can I change the terms to 'unfurnished' and reclaim my furniture?

I'd like to counter Hipppo's argument with a different view point, but I can't.  So it's a no from me.

I would be surprised, simply because the AST is still in force, albeit in its SPT phase.  To change the terms of the contract you would have to terminate it, change it and reissue it.  No sure Mr T would like that.

Like what everyone else has said, the answer is no.

When a tenancy rolls into periodic, the original terms of the tenancy doesn't change. The only difference is that it becomes a monthly/weekly (depending on how frequently the rent is paid) rolling contract.

Are they still paying rent on time, out of curiosity?

Hi Benson, it's what the others said. You will have to terminate the current contract and start a new one.
