Hi,
Has anyone been in my situation?
I've a tenant who's being verbally abusive to myself and also to my husband, all because I wanted to inspect my property after 18 months smoke alarms etc.. Hes been smoking in the property when it clearly states not in in the tenancy agreement and I've also found out he's sub letting  at least 3 other males. Among other issues..
AST ends at the end of this month, best decided to give him a section 21 to get my tenancy back.
It was recommended iI call my tenant,  as a curtesy call, to let him know I'm Nort renewing the tenancy at the end of the month, give him 2 months notice but I've called several times now but he just cancels my call.

Can I just issue him the section 21 notice to seek my property back?

Yes you can.  You know you have to get a court order if they don't leave though?  Did you protect the deposit correctly?  Your section 21 won't be valid if you didn't.

Yes I protected the bond.
I'm just worring he will damage my property within the 2 month period and then there's also the 2 months rent he's more than likely not going to pay. He still owes some outstanding rent from 3 months ago.

That's always a worry.  Nothing you can do to mitigate that risk at the moment.  Are they working?

I've tried calling the tenant but he just keeps cancelling my call before he picks up!
I've now sent him the s21 think once he receives the notice  it may make him call me.. Who knows...
Im guessing he's thinking if he ignores the situation I'm just going to go away, as done previously when he was abusive to me on the telephone at the beginning of the tenancy.
Yes the tenant works and I've being told at least two of the sub letters he has living with him also do.

If he's working then you can worry a little less as you can sue for any damages once the tenancy is over.
